In 2009, EvolvHealth got into trouble with the University of Texas Board of Regents when it asked the M.D. Anderson Cancer Center to test its bottled water made from all-natural ingredients like alfalfa stems and leaves, milk whey, and enzymes from pineapple and papaya.
What happened next, however, was the result of a federal lawsuit filed in November 2009 in Houston.
According to the lawsuit, M.D. Anderson conducted “preliminary” tests and never double-checked their “safety, efficacy, medicinal, or beneficial health value.”
Evolv, on the other hand, began running content on its website like, “The Archaea Active formula has undergone in-vitro testing by The University of Texas M.D. Anderson Cancer Center in Houston.”
M.D. Anderson believes this gives the impression that the cancer center has endorsed the product.
